Landon’s litigation practice focuses on corporate governance and shareholder disputes, copyright, trademark, and trade secret matters, and commercial disputes involving contracts, business torts, and unfair competition laws. Landon also has extensive experience representing government entities and representatives in litigation before trial and appellate courts concerning complex and politically sensitive matters, including Proposition 8, Proposition 83 (Jessica’s Law), and affirmative action. Landon has frequently litigated First Amendment issues, and has obtained dismissals of complaints against multiple clients through anti-SLAPP motions. He has also advised companies on international privacy law restrictions and obligations, represented investment brokers in FINRA arbitration proceedings, assisted with internal corporate investigations, and advised technology-intensive companies in complex intellectual property transactions.
Represented Governor Arnold Schwarzenegger and various other state officials in federal court in constitutional challenge brought by same-sex couples seeking to invalidate California’s Proposition 8 defining marriage as between a man and a woman on federal equal protection and due process grounds.
Defended prominent electronic music festival promotion company and its principal against alleged violations of the False Claims Act and Government Code section 1090, unfair competition, fraud, and civil conspiracy. Claims against company and its principal were dismissed on the pleadings with prejudice following multiple sustained demurrers.
Negotiated substantial settlement for music artist in claims against publisher for copyright infringement, misappropriation of royalties, and breach of contract.
Represented ethanol trade organization seeking to intervene in mandamus challenges to California regulations concerning fuel ethanol. Prevailed on motion seeking leave to file complaint in intervention, and assisted named defendants in successfully defeating challenges and preserving California fuel ethanol regulatory standards.
Successfully defended non-profit youth sports organization against allegations of slander and negligence. Anti-SLAPP motion challenging the complaint led to prompt settlement for no liability.
Obtained favorable settlement for celebrity photographer asserting copyright and slander of title claims for unauthorized use and misidentification of famous photograph.
Successfully represented Governor Arnold Schwarzenegger and California Department of Corrections and Rehabilitation in numerous state and federal court proceedings challenging the constitutionality of Proposition 83 (“Jessica’s Law”) and attempting to enjoin the Department’s enforcement of Proposition 83’s residency restriction and GPS monitoring provisions.
Represented one of three former business partners in dispute arising from dissolved construction supply company. Successfully mediated the matter and obtained a stipulated dismissal without monetary settlement.
Tried a shareholder derivative suit on behalf of privately held company against a minority shareholder’s claims concerning management and corporate governance.
Served as Special Counsel for Chapter 11 Bankruptcy Trustee in adversary proceeding against debtor for breach of fiduciary duty, fraud, and common counts. Obtained multi-million dollar settlement on behalf of the bankruptcy trust.
Represented an individual entrepreneur against his former employer’s contract and conversion claims, and in his cross-claims for trademark infringement, misappropriation, and breach of contract. Obtained favorable monetary settlement for client in mediation.
